PRIVACY AND DATA SECURITY POLICY

This Privacy and Data Security Policy explains who is responsible for the personal data of those users (hereinafter, «Candidate,» «The User,» or «Job Seeker») who seek employment or related services and access and/or use the services of the employment web portal and/or mobile application “______________” and how the aforementioned personal data (hereinafter, «Personal Data» or «Candidate’s Personal Data») is collected, shared, and processed, as well as the rights that «Candidates» have in this regard and how they can exercise them. For RH EXPERTISE, SOCIEDAD ANÓNIMA, it is essential to maintain the privacy and security of the Personal Data of the «Candidates.»

1. PURPOSES

The objective of RH EXPERTISE, SOCIEDAD ANÓNIMA through the services offered on the website «www.rhexpertise.com» in Guatemala is to facilitate contact between «Candidates» or «Job Seekers» in Guatemala and employers or recruiting companies that offer job positions in that country (Professional Users or Job Providers), providing tools and services that support job search processes in Guatemala.

2. DATA WE COLLECT

RH EXPERTISE, SOCIEDAD ANÓNIMA acknowledges that it obtains information from various users (hereinafter «The User»), who provide it in order to receive the services offered on this «Site». Such information may consist of personal data, such as name, email address, physical address, phone number, fax number, academic data, work experience and skills, preferences, interests, a photograph, city or location, and others that are used to contact you and/or deliver the products or services that have been requested. If applicable, «Users» may also provide other information, such as ID numbers, DPI, passport, and other required information related to the services offered on the «Site,» which can be received in writing or electronically, allowing «The User» to upload a Curriculum Vitae (C.V.) to our web portal in Word or Pdf format.

DATA RETENTION PERIOD

The Personal Data provided by «The User» will be retained as long as their account on our web portal remains active or as long as necessary to provide our services, until «The User» requests its deletion, as well as for the time necessary to fulfill legal obligations.

1. USER RIGHTS
As the holder of the Personal Data transferred by «Users» in accordance with the specifications in this Policy, they will have the following rights:

Access or collect your Data: You may request a copy of your Personal Data.
Change or rectify Data: You can edit part of your Personal Data through the private area on the website. Likewise, you can request the modification, update, or correction of your Data if it is not accurate.

RH EXPERTISE, SOCIEDAD ANÓNIMA, declares that it will not market, sell, or share the information provided by «The User»; and in any case, it will be used to fulfill the services offered.

RH EXPERTISE, SOCIEDAD ANÓNIMA is a law-abiding entity, therefore, it adheres to each of the provisions, to the extent applicable, as established in Decree 57-2008 of the Congress of the Republic of Guatemala, Public Access to Information Law.

VERACITY OF THE PROVIDED INFORMATION.

«The User» declares and guarantees that the information provided by him, through this «Site» to RH EXPERTISE, SOCIEDAD ANÓNIMA is true and that he has full control over it.

«The User» agrees that RH EXPERTISE, SOCIEDAD ANÓNIMA is not responsible for any loss, property damage, or personal injury caused to «The User» by the equipment, programs installed on «The User’s» machine that were not developed by RH EXPERTISE, SOCIEDAD ANÓNIMA, by Internet browser programs, or by the provision of the services subject to this contract. RH EXPERTISE, SOCIEDAD ANÓNIMA will also not be responsible for any direct, indirect, special, consequential, economic, or any other type of damage that arises as a consequence of the installation, use, or maintenance of the equipment and programs necessary for the «User» to utilize the services provided through «The System.» In any case, the «User» is responsible for configuring their Internet browser, having antivirus protection, antiSpyware, firewall, or any other hardware or software product that serves to safeguard the privacy of the information provided by the «User» within the secure area of the «Site.» The responsibility of RH EXPERTISE, SOCIEDAD ANÓNIMA in relation to this contract and those related to it is limited to exercising ordinary care and acting in «good faith» by RH EXPERTISE, SOCIEDAD ANÓNIMA, with the use and handling of the information provided by «The User». RH EXPERTISE, SOCIEDAD ANÓNIMA is not responsible for delays or non-execution, nor for the accuracy or veracity of any information or instruction provided by the «User» or their authorized persons to access and instruct others. Under no circumstances shall RH EXPERTISE, SOCIEDAD ANÓNIMA be liable for special, incidental, direct, or indirect damages, even if RH EXPERTISE, SOCIEDAD ANÓNIMA has been notified of the possibility of such damages. RH EXPERTISE, SOCIEDAD ANÓNIMA shall also not be liable for the obstruction, hindrance, postponement, or non-execution of the instructions received from the «User» caused by fortuitous events and/or force majeure, including, but not limited to, any natural, technological, or similar cause beyond the control of RH EXPERTISE, SOCIEDAD ANÓNIMA or any of its representatives and related entities.

1. SECURITY

RH EXPERTISE, SOCIEDAD ANÓNIMA is committed to ensuring the security and confidentiality of Personal Data. Therefore, appropriate security measures and technical means have been adopted to prevent their loss, misuse, or unauthorized access by «Users» and/or third parties. RH EXPERTISE, SOCIEDAD ANÓNIMA also has procedures in place to act upon any suspicion of a breach of the security of the Personal Data being processed. RH EXPERTISE, SOCIEDAD ANÓNIMA will make the appropriate notification to the user and the applicable authority in the event of a breach of Personal Data security, when required by law.
